Rules

1. General provisions

1.1 Terms used in these Terms and Conditions listed below shall be defined as follows:
a. Ordering Party - a person booking a transport service, hereinafter referred to as "transfer", for himself/herself or a third party.
b. Passenger - a person using the transport service, hereinafter referred to as "transfer".
c. Contractor - the company JAROSŁAW MISTARZ - "TAKSÓWKA OSOBOWA", ul. Celiny 1, 32-031 Mogilany, providing transport services (transfer) on the basis of permits and licenses issued by competent public administration authorities.
d. Confirmation of the reservation - confirmation by the Contractor of the acceptance of the order from the Ordering Party, sent by e-mail, within a specified period and for the agreed price.
e. Contract of carriage - a contract concluded between the Contractor and the Ordering Party at the time of booking; Based on its provisions, the Contractor undertakes to transfer the Passenger and his luggage for a specified fee from the selected address to the destination address indicated in the order.
f. Tour - transfer to the destination, waiting for the client until the end of the agreed tour time and returning to the starting point.


1.2 Making a reservation for a given transfer is tantamount to concluding a contract and accepting the provisions of these Terms and Conditions.

 


2. Booking and purchase of the service.

2.1 Transfers are subject to reservation, provided that the latter has been made at least 24 hours in advance of the planned transfer, unless the Contractor allows the shortening of this time.


2.2 Transfer booking is possible using the booking form available on the website www.krakow-taxi.com.

2.3 The Ordering Party is obliged to provide the Passenger's name and surname or company name, number of passengers and the number of pieces of luggage, current contact telephone number of the Passenger (including area codes), e-mail address and flight number, in the case of ordering the Passenger pickup service from the airport.

2.4 Providing the data listed in point 2.3 is voluntary, but necessary for the transfer to take place.

2.5 If the Passenger is traveling with a child requiring a car seat, the Ordering Party should inform the Contractor about the need to install the seat and about the child's age at the stage of completing the booking form in the "other comments" section.

2.6 The Ordering Party accepts full responsibility for the data provided to the Contractor during the booking process.

 

3. Tours

3.1 The contractor emphasizes that he is not the tour operator himself, but is only responsible for the customer's transport.

3.2 All organizational aspects of the trip, including admission tickets, the duration of the trip and others, are the sole responsibility of the Customer. The Contractor shall not be liable for the lack of an admission ticket, delay for sightseeing and other undesirable consequences resulting from improper departure time planning by the Ordering Party. Such a situation does not entitle the Passenger or the Ordering Party to claim any compensation or reimbursement on this account.

 

4. Travel

4.1 The Passenger should arrive at the address indicated in the order (not applicable to airport pickup) no later than within 15 minutes after the agreed time. If the driver is not able to contact the Passenger or if he has to wait longer for him, he has the right to depart without informing the Passenger or the Ordering Party about it. This situation releases the Contractor from liability, and does not entitle the Passenger or the Ordering Party to claim any compensation or reimbursement on this account.

4.2 In the event of picking up a Passenger from the airport, the driver will wait for the Passenger with a sign with his name or company name in the terminal in the arrivals hall in a public area, which is most often located at the exit from the baggage claim area. The waiting time of the driver is 60 minutes from the moment the plane lands. If during this time the Passenger does not find the driver waiting for him, the latter has the right to leave without informing the Passenger or the Ordering Party about it. Such a situation releases the Contractor from liability for the situation, and does not entitle the Passenger or the Ordering Party to claim any compensation and reimbursement of costs.

4.3 In extreme, very rare cases, it may happen that the driver is late to pick up the passenger on the given transfer. In such a case, the Passenger should wait for the driver until the latter arrives. If such a situation occurs, both the Passenger and the Ordering Party may not claim any compensation or reimbursement in this respect. The Contractor is then released from any liability.

4.4 If it is impossible to reach the address indicated by the Ordering Party by car or the regulations prohibit it, the driver will stop in the nearest possible place, where it is allowed by road traffic regulations.

4.5 The passenger is obliged to comply with the order regulations in force in transport and the recommendations of the vehicle driver.

4.6 The Passenger is responsible for damage caused to the Contractor (including in particular damage to the car) and other Passengers on the general principles provided for in the Civil Code. In the event that the amount due from the Passenger cannot be obtained, the responsibility for the damage caused rests with the Ordering Party. The cost of contamination of the upholstery, which will require washing, is PLN 500.

4.7 If the car is equipped with seat belts, the Passenger is obliged to use these belts during the journey.

4.8 You can use the Wi-Fi network in the car only in the territory of the Republic of Poland.

4.9 If a Passenger wants to use the car charger, he/she must have a suitable cable with a USB port. The Contractor does not guarantee that the charger will be compatible with the Passenger's phone/smartphone.

4.10 The Contractor reserves the right to make the transfer by car other than the one shown in the photos at www.krakow-taxi.com.

4.11 The passenger is covered by the driver's personal accident insurance. The insurance covers only situations that may occur during the Passenger's stay in the vehicle. Other random events causing damage to the Passenger caused outside the vehicle are not covered by this insurance.

4.12 The driver has the right to prevent the passenger from taking a seat in the vehicle or refuse further transport without the need to reimburse the costs incurred by the Ordering Party in connection with the transfer, if:
a. the Passenger does not comply with the provisions of these Regulations,
b. the Passenger is in a state indicating the consumption of alcohol or intoxicants (e.g. drugs),
c. Passenger behaves in a way that is inconvenient to his fellow passengers and / or the driver,
d. the passenger is aggressive,
e. the Passenger does not comply with the driver's safety instructions (e.g. refuses to fasten seat belts),
f. the number of people is greater than the number specified in the booking form,
g. the Passenger wants to change the travel route previously determined in the booking form
h. when completing the reservation form, the Ordering Party did not provide information about the intention to transport animals, children, large-size and non-standard luggage (e.g. bicycle, skis, pram, wheelchair, etc.),
i. the passenger has luggage that exceeds the dimensions of the luggage compartment, the reason may be too many pieces of luggage or the dimensions of this luggage,
j. the Passenger grossly violates generally accepted standards of cleanliness, hygiene and personal culture,
k. the Passenger, despite arriving at the indicated place and time, delays the moment of the transfer service (e.g. by making unexpected purchases, eating a meal, etc.),
l. the plane by which the Passenger was to arrive at the agreed pickup point will be redirected to another airport,

4.13 The legal consequences of the events listed in point 4.12 shall be borne by the Passenger. The exercise by the Contractor of the rights referred to in this point does not entitle the Passenger or the Ordering Party to demand any compensation or reimbursement of costs.

4.14 The Contractor reserves the right to charge an additional fee - at his discretion - in the following cases:
a. the stop is longer than previously planned,
b. the tour time has been extended (the estimated trip time is given in the "Tours" tab),
c. the number of passengers is greater than the number indicated when completing the booking form,
d. the amount of luggage is greater than specified in the booking form,
e. the Passenger has changed the travel plan,
f. the Ordering Party or the Passenger have non-standard wishes (e.g. a bottle of champagne in the car, a driver wearing a suit, etc.)
g. passenger has contaminated the vehicle.

4.15 In the situations described in point 4.14, the Passenger is obliged to pay an additional fee at the Contractor's discretion in cash or by card. If the Passenger does not agree to an additional fee, the transfer will be terminated immediately. Such a situation releases the Contractor from liability, and does not entitle the Passenger or the Ordering Party to claim any compensation or reimbursement for it.

4.16 It is forbidden to eat in vehicles, drink alcoholic beverages, smoke and use the intoxicants.

4.17 The Contractor will make every effort to transport the Passenger and his luggage in a timely manner, in accordance with the agreed travel time, with the reservation, however, that for reasons beyond his control, he cannot guarantee it (weather conditions, road conditions, unforeseen car breakdown).

4.18 In special cases (change of the flight time, change of check-in time due to increased passenger traffic or safety reasons, bad weather conditions forecast), the Contractor reserves the right to refuse to change the departure time or the place indicated in the order due to the non-availability of the service. Possible changes may be reported up to 24 hours before the trip, but they will not necessarily be accepted by the Contractor.

 

5. Payment

5.1 The Ordering Party may choose from several payment methods: PayU, PayPal, cash, bank transfer or card payment.

5.2 In the case of PayU, PayPal and bank transfer, the money must be registered on the Contractor's account at least 24 hours before the planned transfer. If this condition is not met, the Contractor reserves the right to cancel the transfer. Such a situation releases the Contractor from liability for the situation, and does not entitle the Passenger or the Ordering Party to claim any compensation in this respect.

5.3 It is possible to pay by credit card. The fee is paid to the driver before the transfer is made. Supported payment cards are Mastercard, Visa and American Express.

5.4 Payment in cash is made to the driver prior to the transfer. the customer can also pay the amount due in currencies such as USD, EURO and GBP. In this case, the conversion factor is as follows:
a. 1 USD = 3,50 PLN
b. 1 EURO = 4,00 PLN
c. 1 GBP = 4,50 PLN

 

6. Cancellations and Refunds

6.1 In the event of cancellation of the transfer later than 24 hours after the agreed transfer, the Ordering Party is entitled to a refund of 92% of the amount paid.

6.2 In the event of cancellation of the transfer earlier than 24 hours from the time of the scheduled transfer, the Ordering Party shall not be entitled to a refund of the transfer fee.

 

7. Luggage

7.1 The excess amount of luggage should be previously agreed with the Contractor (pram or wheelchair, sports equipment, bicycles, etc.).

7.2 Items left in the car are not covered by the protection and responsibility of the Contractor,

7.3 The contractor provides the transport of three medium-sized suitcases. In the event of an excess amount of luggage, the driver will make the transfer only if the luggage fits into the luggage compartment. Otherwise, the Contractor has the right to refuse to execute the order. Such a situation releases the Contractor from liability for the transfer, and does not entitle the Passenger or the Ordering Party to claim any compensation or reimbursement for it.

 

8. Complaints

8.1 Complaints arising from the performance of the contract of carriage should be sent to the Contractor's address (JAROSŁAW MISTARZ TAXI PERSON, ul. Celiny 1, 32-031 Mogilany) only in writing, within 30 days from the occurrence of the circumstances being the subject of the complaint. The person authorized to file a complaint is the Ordering Party or its legal guardian. Complaints submitted by third parties will not be considered.

8.2 The Contractor accepts complaints submitted by e-mail to the following e-mail address: www@krakow-taxi.com

8.3 The Contractor considers complaints within 30 days from the date of delivery.

8.4 Any disputes that arise in connection with the implementation of these regulations will be settled first of all amicably. If no agreement is reached, the court competent to settle any disputes in this respect will be the court having jurisdiction over the seat of the Contractor.

 

9. General Personal Data Protection Policy

Pursuant to Art. 13 sec. 1 and sec. 2 of the General Data Protection Regulation of 27 April 2016, it should be indicated that:
The Controller of your personal data is "JAROSŁAW MISTARZ TAKSÓWKA OSOBOWA" based in Mogilany;
Your personal data will be processed for the purpose of booking a service pursuant to art. 6 section 1 point a);
The personal data provided by you will not be shared with external companies; The personal data provided by you will not be transferred to a third country; Your personal data will be stored until the withdrawal of consent; You have the right to access your data and the right to rectify it, delete it, the right to limit its processing, the right to transfer data, the right to object, to withdraw consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal; You have the right to lodge a complaint with the independent data protection authority, if you feel that the processing of your personal data violates the provisions of the General Data Protection Regulation of April 27, 2016; Providing your personal data is voluntary, but required to complete the booking; Your personal data shall not be subject to automated individual decision-making, including profiling.

 

10. Final Provisions

To all matters not settled herein the appropriate following provisions shall respectively apply: i.e. Article 23 and 24 of the statute of 23 April 1964 - the Polish Civil Code (Journal of Laws No. 16, item 93 as amended).
The following Terms and Conditions have been drawn up in several different language versions.
In the case of a discrepancy between the Polish version and other translated versions of this Terms and Conditions, the Polish version will be considered binding.
